    3. Customer is a legal entity with whom NextMediahas an agreement to provide the Services

    Your privacy and the protection of your data are important to us. You and the legislator decide if and how we process your data: Either you allow us to or we have a legal permission. In the following we describe how we collect and use information.

    2. About NextMedia
    NextMedia provides a platform that allows our Customers to create, store and manage conditions of transferring messages between their business systems and their customers on a variety of NextMedia-supported messaging channels (the "Service").

    NextMedia is committed to the protection of Personal Data, including data that we use for our own purposes, and that we maintain on behalf of our Customers.

    3. Data Protection online
    NextMedia is the sole owner of the information collected on the website. We do not sell, share, or transfer this information, except as set out later in this Agreement. We use your information to improve the website's performance, improve our marketing, and for administration.

    Any third party provider of services to NextMedia is subject to strict obligations to maintain confidentiality and to comply with applicable data protection laws. The information we collect is described below.

    If you visit our website some data is sent to us by your browser and will be recorded, like e.g. type and version of your browser, your operating system, NextMedia webpages you visited, date and time of your visit, your IP address, etc.

    We use this information anonymously to analyse trends, administer and optimise the website, track users' movements on our website, and to gather statistical information about the use. We do not calculate a fingerprint from this information. We store this information for 7 days.

    4. Purposes of the processing and legal basis
    These personal details shall be processed solely to respond and deal with the requests for information made by subscribers, WHICH INCLUDES:

    To manage your access to the services provided by the NextMedia, your customer opinion on products, services or contents.

    To carry out operations that relate to the management of customers concerning the contracts, orders, deliveries and invoices, and manage the unpaid invoices and possible disputes about the use of our products and services.

    By those purposes, the personal data will be kept as long as our relationship ends. The personal data shall be kept during preservation periods for legally stipulated liabilities.

    To send advertising information on news and offers regarding the products and services, promotions and innovations related to the activity of the Customer via any channel, including e-mail.

    If the Customer disputes the personal data treatment for this purpose, the Customer shall withdraw the consent at any time by contacting NextMedia.

    The legal basis for the processing is the freely given consent. You are requested, for this purpose, to give your consent to this privacy policy. Failure to accept this privacy policy will imply that the services rendered and website contents offered by NextMedia shall not be made available and that the system subscription process shall be interrupted.

    5. Registration
    If you decide to register for our personalised service we collect some personal information like name, address, and other contact data. Registered users may always update or delete those data. Furthermore, upon your request, we inform you which personal data we have stored about you.

    6. Newsletter
    When you register for our newsletter we use your data only for this purpose. In order for your registration to take effect we use the 'double-opt-in' procedure: We validate your email address by sending a confirmation email containing a link.

    You may withdraw your consent to store your personal data in order to receive our newsletter at any time. At the end of every newsletter you will find a link to unsubscribe.

    7. Contact Form
    If you contact us via email or our contact form your data is stored in order to process your request and for follow-up questions.

    8. Fee-based Services
    In order to provide fee-based services we ask for additional data like payment details. To secure these data during transmission we use state-of-the-art encryption.

    Google-Analytics We use Google Analytics, a web-analysis provided by Google Inc. ('Google').

    Google Analytics uses so-called 'Cookies', text files stored on your computer that enable an analysis of your use of our website. Information gathered with the help of Cookies about your use of this website is regularly being transferred to servers operated by Google in the United States of America ('US') and stored there. We employ IP anonymization (so-called 'IP-masking') so that your IP address will be shortened by Google in the European Economic Area before being transferred to the US. Only in exceptional cases such as a technical failure, it may happen that your full IP address may be transferred to Google servers in the US and then be shortened, there. On our behalf, Google uses this information to examine your use of the website, to provide reports about the website's use and to provide us with related services. The IP address transferred by your browser will not be combined with other data by Google.

    You may block the storage of Cookies by adjusting your browser settings; however, in this case not all functions of the website may still be available.     9. Your right to know, correct, block, delete, and contradict
    It is your right to be informed about the personal data we have stored. Likewise, it is your right to correct, block, and delete your data – given that legislation allows for the latter. In order for a block to work your data has to stored in a blacklist.

    You can communicate data changes or the withdrawal of your consent to to process your data by sending a corresponding message.

    10. Changes to NextMedia's Privacy Policy
    This document is regularly reviewed and is subject to change at our discretion to reflect legal requirements or new services.

    11. Privacy and security settings
    NextMedia reserves the right to amend this policy in order to adapt it to new regulations or case laws and industrial and/or commercial practice.

    If NextMedia decides to change its Privacy Policy, it will post those changes on this page. This policy was last modified on November 19th, 2019.

    Under all circumstances, users must read and expressly accept to consent the data treatment referred by this Privacy Policy, before using the services.

    NextMedia has adopted the Data protection security legally required and strives to install additional technical measures and means within its scope to avoid the loss, misuse, alteration, unauthorised access to and theft of the personal details provided. NextMedia agrees to use all of the details sent by registered users with the utmost confidentiality and resilience.

    NextMedia will store the personal data until the personal data are no longer necessary for the purposes for which they were collected or when the data subject withdraws consent on which the processing is based. Hence, shall not be applied, and the personal data will keep stored when that processing is necessary for compliance with a legal obligation.

    12. Recipients and personal data transfer
    NextMedia guarantees that under no circumstances shall it notify, or transfer said details to third parties, except where expressly authorised by the users. The data could be communicated to the following third-party recipients: Public Administrations for compliance with legal obligations. They can also communicate to the following categories of recipients: Suppliers of electronic communications services and online office automation, hosting, SaaS services such as CRM/ERP, management, accounting, auditing and lawyers. NextMedia could transfer personal data to recipients located in the United States of America, who are included in the Privacy Shield list, which has a decision to adopt the European Commission.

    13. Rights of the users
    Users are, at any time, entitled to exercise their rights of access, rectification, erasure, restriction of processing, data portability, not to be subject to a decision based solely on automated processing, including profiling, and object, by contacting NextMedia and sending written notification to info@nextmedia.pro, attaching a copy of their National Identity Document or another equivalent identity document. The users have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. The users have, as well, the right to lodge a complaint with a supervisory authority.
